What is Banking law?
The course in Domestic and International Banking Law at City
University is a two term course. In the first term students cover the
contractual aspects of the banker-customer relationship including
set-off and confidentiality. Regulatory aspects are important and
the regulation of consumer credit, financial services and deposit
taking are looked at. The FSMA 2000 makes this topic important
and topical. The term concludes with a look at electronic banking
and the protection of consumers under the UCTA and UCCTR.
The second term is a change of theme with International banking
documentation the forefront of the course. Guarantees and
Performance Bonds are considered. Lending and the standard
contractual terms are discussed with emphasis on the clauses.
This is extended into derivatives. The course concludes with a
different form of financing, namely eurobonds and the eurobond
market and the standard type terms included in a eurobond.
