R (on the application of Quintavalle) v Secretary of State for Health [2002] 2 WLR 550
Full text of this decision relating to whether an organism created by cloning technology (cell nuclear replacement), could in fact be aligned with the definition of 'embryo' within the Human Fertilisation and Embryology Act 1990 s.1. The Court of Appeal allowed the appeal, using the Human Rights Act 1998 in order that the scope of purposive construction might be extended. It was established that an embryo created by this CNR had the same genetic makeup as a naturally fertilised embryo. This decision has been affirmed by the HL in [2003] 2 AC 687.
