Case regarding a 30 year old woman who accused both the Minister of National Health and Welfare, and the Pension Plan Review Tribunal of age discrimination, contrary to s.15 (1) of the Canadian Charter of Rights and Freedoms. She was denied survivor's benefits after the death of her husband, because the threshold age for receiving benefits was 35. Law queried whether the constitution was infringed by the Canada Pension Plan, as it discriminated against women under 45.
