Eurocracy and distrust: some questions concerning the role of the ECJ in the protection of fundamental human rights within the legal order of the European Communities - Weiler, J
Topic Category: EU - Articles
Very long article discussing the level of human rights protection offered to individuals under different constitutions. Some of Weiler's sections are as follows: the judicial evolution of the protection of human rights and judicial adjudication of human rights - how is it actually done? Weiler concludes by declaring that the potential Community incorporation would have to be achieved as part of a two-stage process (by the ECJ and then the national courts), and he recognises that this is unlikely to be in the near future. 61 WALR 1103
