Caught in the Tangled Web - Speirs, A
This paper, originally published as a Newcastle Law School Working Paper, examines the judgment in Twinsectra Ltd v Yardley and Others [1999] Lloyds Rep Bank 438. Speirs states that the case 'raised two important questions relating to trusts'. These concerned whether the conditions attached to the commercial loan were made the subject matter of a 'Quistclose trust' and indeed whether the solicitor could be held liable for his assistance in this breach of trust.
