The authors discuss the meaning of "duty of care" in the offence of gross negligence manslaughter. For example, does the duty of care have the same meaning in criminal law as in tort? Who decides whether the duty of care arises on the facts - the judge or the jury? The authors look at these and other issues, and review relevant case law on the subject.  Crim LR 24
